
Driving School Terms and Conditions



These form a contract between the pupil and driving instructor and are subject to the following terms and conditions:

The pupils certifies that a valid suitable licence is held to drive the tuition vehicle. Pupils must inform their instructor immediately if they receive any endorsements on their licence (failure to do so may void insurance cover for the duration of their lesson). Pupils must always have their driving licence with them during lessons.

Your instructor reserves the right to request licence check details prior to lessons beginning, or at any time whilst you remain a pupil with them.

The instructor will refuse to proceed with a lesson if they have reason to believe that the pupil is in any way under the influence of drink or drugs.

The instructor will do everything possible to ensure that lessons start and finish on time, but reserves the right to cancel, postpone or change lesson lengths and start/finish times under certain circumstances (e.g. dangerous weather conditions). In the event of postponement, fees paid in advance will be carried forward.

Cancellations by the pupil require a minimum of 24hrs notice prior to the lesson start time. Failure to give such notice will result in the full tuition fee becoming payable.

Frequent cancellation or changes to booked lesson times/dates by the pupil may result in termination of this contract by the instructor. In this case any pre-paid monies will be refunded to the pupil, minus any late cancellation charges as per condition number 5.

Payment for lessons is due in advance or by midnight on the day of your lesson unless prior arrangement has been made. Payment should be made by bank transfer.

Any outstanding monies must be settled prior to your next lesson and/or practical test. The instructor reserves the right to refuse a lesson or the use of the driving school vehicle if an amount is owed.

The instructor reserves the right to refuse the use of the driving school vehicle for test if they consider the pupil not to be test ready and/or the provision of a vehicle could cause a risk to public safety.

While your instructor will make every effort to ensure that the vehicle supplied for test will be fully road worthy and comply with all legal requirements at the start of the test, he/she cannot be held responsible for vehicle failure that occurs during the test and is not liable for consequential loss.

Should the DVSA give less than 24hrs notice of a driving test cancellation the pre-test tuition/test time fee will still be payable.

Whilst carrying out a practical driving test the pupil is liable for the total cost of any damage to tyres, wheels, wing mirrors or any other part of the vehicle (internally and externally). They also accept full liability for the insurance excess of any insurance claim that is deemed to be their fault.

The instructor will accept not responsibility for accidents, injury or damage to any third party caused by the pupils’ recklessness or negligence during a lesson.

Whenever you are driving in the tuition vehicle, you will be under close supervision, however, your instructor cannot be held responsible for any infringement of the law. Any fines or penalties incurred will be the responsibility of the driver.

If the instructor is unable to continue tuition a full refund will be given of monies paid in advance for tuition that has not been delivered. Additionally, no administration charges will be applied should a pupil request the refund of monies paid in advance.

To celebrate our success as a driving school, once you have passed your test, we would like to take a photo of you holding your certificate which we will upload to our Social Media pages. The may include, without limitation: Facebook, Instagram, LinkedIn & X (formerly Twitter). These images may also be displayed on the driving school’s website www.overthehillsdrivingacademy.co.uk.

You consent to the storage and use of your data by Over The Hills Driving Academy as per current www.ico.org.uk regulations, and for them to display images of you as indicated in point 16.
